Welcome to Eatensil (“we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of the website www.eattensil.com (the “Site”) and your purchase and use of our products. By accessing or using our Site, you agree to be bound by these Terms and our Privacy Policy.

Eatensil is a consumer goods brand based in Nairobi, Kenya, specializing in eco-friendly, reusable, and multifunctional cutlery designed for portability, hygiene, and convenience.

By using our Site, you confirm that you are at least 18 years of age or have legal capacity under the laws of your jurisdiction. If you are under 18, you must use the Site with the consent and supervision of a parent or legal guardian.

All orders placed through our Site are subject to acceptance and availability. Prices are listed in Kenyan Shillings (KES) unless otherwise stated. We accept payment via mobile money (Mpesa), credit/debit card, and other methods specified at checkout. We reserve the right to cancel or refuse any order at our discretion, including for suspected fraud.

Eatensil ships only within Kenya but that may change in Future. Shipping times and rates vary based on location and delivery method selected. Customers are responsible for providing accurate shipping information. Eattensil indemnifies itself against delays in shipping caused by third-party couriers, or force majeure events.

We MAY accept returns for defective or damaged products within 14 days of delivery. To qualify for a return:

• Items must be unused, in their original packaging.
• Contact our customer service with your order number and reason for return.

Refunds will be processed using the original method of payment. Shipping costs are non-refundable unless the return is due to our error.

We strive to provide accurate descriptions, images, and information. However, we do not guarantee that the content on the Site is error-free or complete. In addition, product availability is subject to change without notice.

You agree to use the Site for lawful purposes only and not to:

• Violate any applicable laws or regulations.
• Infringe on our intellectual property or the rights of others.
• Introduce malicious software, spam, or disrupt the Site’s operation.

All content on the Site (e.g. logos, product images, text, videos, and graphics) is owned or licensed by Eatensil and protected under Kenyan and international copyright and trademark laws. You may not reproduce, distribute, or exploit our intellectual property without written consent.

To the maximum extent permitted by Kenyan law:

• Eatensil shall not be liable for any indirect, incidental, or consequential damages arising from your use of our Site or products.
• Our total liability shall not exceed the amount you paid for the product in question.

Eatensil provides its products “as-is” without warranties of any kind, express or implied, including fitness for a particular purpose, except where required by law.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. In the event of a dispute:

• Parties shall first attempt to resolve it amicably through negotiation.
• If unresolved, the matter shall be submitted to mediation or arbitration in Nairobi, Kenya, in accordance with the rules of the Chartered Institute of Arbitrators (Kenya Branch).
• The decision of the arbitrator shall be final and binding.

We reserve the right to suspend or terminate access to the Site if you violate these Terms or engage in behavior that is harmful to Eatensil or its customers.

We may update these Terms from time to time. Changes will take effect immediately upon posting on the Site. Your continued use of the Site constitutes acceptance of the revised Terms.
